Clarification from Badgerow's ex-wife
CONFUSION AND CLARITY (Apr 9, 2010)
Confusion and clarity -- those were the two themes that marked the latest testimony in the first-degree murder trial of Robert Badgerow.
The confusion centred around the Wednesday testimony of Badgerow's former wife Tammy Somaz over the question of whether she was able to identify the voice on a taped 911 call made to the police by a male caller two days after the murder of Hamilton nursing assistant Diane Werendowicz in June 1981.
Crown counsel contend the voice belongs to Badgerow, who has pleaded not guilty to first-degree murder in connection with the rape and murder of Werendowicz.
Somaz testified Wednesday that when she heard the tape she could not recognize the voice. But the 12-member jury sent word to Ontario Superior Court Justice Gerald Taylor yesterday that it was confused over the answer the witness provided and asked for some clarity.
Yesterday the tape of Somaz's answer was played to the jury.
The jury heard Crown counsel Cheryl Gzik ask Somaz, "Did you form an opinion whether or not that was the voice of Robert Badgerow?"
On the tape Somaz answers "No" but it was unclear when she continued whether she confirmed or denied she had actually recognized the voice.
Defence lawyer Leo Adler asked Somaz yesterday for a clarification on that specific issue.
"I did not recognize the voice when the tape was played to me," Somaz replied.
When Gzik asked the witness whether her taped testimony appeared to have her answer in the affirmative to the identity question, Somaz said the recording of her Wednesday answer "didn't sound clear to me."
Part of the problem could have been that a faulty bearing in the courtroom's air conditioning system created a noticeable hum Wednesday. the problem has since been repaired.
The identity of the male voice on the 911 call is a crucial issue. the voice provides details of the murder that police believe only Werendowicz's killer could have known. the Ontario Superior Court jury has already heard several of Badgerow's former Dofasco colleagues testify they believe it is the accused's voice on the tape.
Adler played a portion of Badgerow's groom's speech from the couple's April 17, 1982, wedding reception.
"Is that a fair and accurate depiction of Robert Badgerow's voice in 1982," Adler asked Somaz, who divorced the accused in 1985.
Somaz confirmed it was.
"Was that the same voice you knew in 1981?" Adler continued.
"Yes," Somaz replied.
Asked whether she was tailoring her answers in any way or lying to protect her ex-husband, Somaz said she was not.
The trial is expected to continue Monday.
